Can you claim tax-free childcare and universal credit at the same time?
Can you have Tax-Free Childcare and Universal Credit together?
No. The GOV.UK Tax-Free Childcare page If you get Universal Credit or childcare vouchers states: you cannot get Tax-Free Childcare at the same time as claiming Universal Credit or childcare vouchers. The Universal Credit childcare-costs guidance repeats the same wall: you cannot get tax-free childcare if you are on Universal Credit.
Which? and the Low Incomes Tax Reform Group (LITRG) write the same stack rule in plainer words: Tax-Free Childcare is not available while you are claiming Universal Credit, and it is not available with employer childcare vouchers or directly contracted childcare. This page is that yes/no rule. It is not a "which scheme is better" calculator write-up.

Which scheme a household is better off with depends on the situation. GOV.UK points to its childcare calculator rather than a single winner. LITRG says the Universal Credit and Tax-Free Childcare interaction can be complicated and points people to a welfare rights specialist before they cancel a claim.
Are funded hours the same ban?
No. Free Childcare for Working Parents (up to 30 hours a week, 38 weeks a year, from 9 months to 4 years in England on the 2026–27 GOV.UK wording) is a funded-hours scheme. LITRG states you can use Tax-Free Childcare with the government's free hours to pay for costs above those hours. GOV.UK's funded-hours overview says HMRC checks Tax-Free Childcare eligibility when you apply for Free Childcare for Working Parents, and then repeats the wall: you cannot get both Tax-Free Childcare and Universal Credit childcare at the same time.
So a working parent on Universal Credit may still be looking at funded hours. That does not open a Tax-Free Childcare account on top of Universal Credit. A parent using Tax-Free Childcare may still use funded hours for part of the week. The ban is TFC versus Universal Credit (and versus vouchers), not TFC versus the 30-hour code.
How to check the stack rule before you apply
- Read the GOV.UK cannot-at-the-same-time line If anyone in the claim is on Universal Credit, Tax-Free Childcare is closed. If anyone is still on employer childcare vouchers or directly contracted childcare, those have to stop for TFC to run.
- Separate funded hours from the account schemes A 30-hour or 15-hour code is not Tax-Free Childcare. Do not treat an automatic childcare-account letter as permission to run TFC and Universal Credit together.
- If you are comparing money, use the GOV.UK calculator GOV.UK's childcare calculator is the official tool for putting your figures against the schemes. It does not override the stack rule.
- If you apply for Tax-Free Childcare from Universal Credit, wait GOV.UK: wait until you have a decision on the Tax-Free Childcare application before cancelling the Universal Credit claim. LITRG repeats that HMRC advice.
- If you are leaving vouchers, use the 90-day window Tell the employer within 90 days of applying for Tax-Free Childcare. HMRC may ask for evidence that the voucher scheme has stopped. A partner on vouchers must tell their employer too.
What if you want to move from Universal Credit to Tax-Free Childcare?
Ending Universal Credit is a whole-claim decision, not a childcare-only toggle. GOV.UK's only process note on this page is wait for the Tax-Free Childcare decision first. LITRG adds that some people are better off on Tax-Free Childcare and some are better off staying on Universal Credit, and that the interactions can be complicated enough to take to a welfare rights specialist.
Universal Credit childcare itself is a reclaim: you pay the provider, report the costs, and the award can include up to 85% of those costs, with a monthly cap of £1,071.09 for one child or £1,836.16 for two or more from 6 April 2026. Tax-Free Childcare is an account top-up: £2 added per £8 paid in, with a quarterly top-up cap of £500 per child (£1,000 if the child is disabled). Those figures sit side by side for comparison. They are not a reason the stack rule bends.

- Can I keep Universal Credit for rent and use Tax-Free Childcare for the nursery?
- Not on the GOV.UK rule. The ban is Tax-Free Childcare at the same time as claiming Universal Credit, not Tax-Free Childcare at the same time as the childcare element only. Ending Universal Credit is a whole-claim step. GOV.UK says to wait for the Tax-Free Childcare decision first.
- Can I use the 30 hours and still be on Universal Credit?
- Funded hours are a different scheme from Tax-Free Childcare. GOV.UK still says you cannot get Tax-Free Childcare and Universal Credit childcare at the same time. Whether funded hours are open on a Universal Credit claim is a funded-hours eligibility question, not a lift of the TFC stack ban.
- What if my partner still gets childcare vouchers?
- GOV.UK: they also need to tell their employer within 90 days of the Tax-Free Childcare application so the vouchers or directly contracted childcare stop. HMRC may ask for evidence. You cannot run vouchers and Tax-Free Childcare together.
- Does applying for 30 hours automatically start Tax-Free Childcare?
- GOV.UK says HMRC checks Tax-Free Childcare eligibility when you apply for Free Childcare for Working Parents, and Which? notes that a childcare account can be opened as part of that journey. An account existing is not permission to use Tax-Free Childcare while a Universal Credit claim is live.
