What does GOV.UK say about taxis and minicabs?

The exception lives on When a child can travel without a car seat. It applies to licensed taxis and minicabs (private hire vehicles) when the driver does not provide the correct child car seat. Children can then travel without one — but only on a rear seat.

RoSPA’s Child Car Seats site says this is the only exception for children under 3, and that it was introduced for practical rather than safety reasons.

Does Uber or another app count as a minicab?

GOV.UK names licensed taxis and minicabs (private hire). A typical Uber, Bolt or local private-hire booking is a licensed minicab if the operator and driver hold the right licences. Which? files Ubers under the same taxi / minicab exception in its UK law article.

Uber’s own UK kids page restates the GOV.UK split: if you do not have the correct child car seat, children can travel without one only on a rear seat, and must wear an adult belt if they are 3 or older. It also says child seats in Uber vehicles are uncommon, so assume you need to bring one if you want a seat in the car.

An unbooked lift in a friend’s car is not a licensed taxi. The taxi exception does not move across to a private car, even for a short hop from the station.

Can the driver refuse a seat I bring?

Yes. The exemption is about what the law allows when no correct seat is provided. It does not force a driver to accept a seat you unfold on the pavement. Uber’s UK page says drivers can decline the ride if you do not have the appropriate car seat or if they are not comfortable with you installing one in their car.

If you do install a seat, the usual fitting rules still apply: follow the seat’s approved method, and deactivate a front airbag before a rear-facing baby seat goes in the front. Most taxi use of this exception is in the rear, which is the only place GOV.UK allows travel without a child seat.

How do I apply the taxi rule on the day?

What this exemption is not

It is not a free-for-all for any hired car, the front seat, or a child sitting on a lap. It is not a rule that the driver must carry a seat. It is a narrow rear-seat exception for licensed taxis and minicabs when the correct child car seat is not provided.
