Should I wait for a Tax-Free Childcare decision before cancelling Universal Credit?

What is the official order GOV.UK gives?

On If you get Universal Credit or childcare vouchers, GOV.UK puts the sequence in one line: wait until you get a decision on your Tax-Free Childcare application before cancelling your Universal Credit claim. That is the process parents actually need. Thin calculator blogs skip it and leave people cancelling Universal Credit first, then discovering another Tax-Free Childcare rule would have refused them anyway.

The same GOV.UK page also says you cannot get Tax-Free Childcare at the same time as Universal Credit, and that which scheme you are better off with depends on your situation. The Universal Credit if you have children guidance adds that you cannot open a Tax-Free Childcare account until you close the Universal Credit claim. Read together: the first application is for a decision, not for a working account while Universal Credit is still payable.

Official order, in GOV.UK’s words: apply for Tax-Free Childcare → wait for the decision → only then cancel Universal Credit. HMRC’s TFC12050 manual says the same thing from the other side: do not cancel Universal Credit before you are sure you are eligible for Tax-Free Childcare.

Why does HMRC want a decision before you cancel Universal Credit?

HMRC’s Tax-Free Childcare technical manual at TFC12050 is written for staff, but the parent meaning is simple. On the date of a Tax-Free Childcare declaration you must not be receiving Universal Credit, and there must not be a live claim that could still put Universal Credit into payment for that assessment period or the following three months. A Universal Credit award that has been reduced to nil still counts as payable for this test.

If you cancel Universal Credit first, you have already given up the standard allowance, child amounts, housing and the 85% childcare element. If HMRC then refuses Tax-Free Childcare for a different reason — income, immigration status, a partner who is not in qualifying work, a child who is not a qualifying child — you have a gap on both sides. The test application exists so that the only remaining barrier, if any, is the live Universal Credit claim.

This page is the decision sequence, not a cashflow guide for paying the nursery before Universal Credit reimburses you. That is a separate process: paying the nursery before Universal Credit pays you back.

How do I wait for a Tax-Free Childcare decision without closing Universal Credit?

  1. Keep the Universal Credit claim open Do not use ‘close my claim’ or a journal message that ends the award until you have a Tax-Free Childcare decision in writing in the childcare account or by letter.
  2. Apply for Tax-Free Childcare anyway HMRC’s TFC12050 workaround is to apply while Universal Credit is still live, even though that claim makes you ineligible. The decision tells you whether anything else would refuse you. How to do that in parent English is on apply while still claiming Universal Credit.
  3. Read the decision, not the marketing name GOV.UK’s apply page says you usually find out immediately, or within 10 days if extra checks are needed, and that it can take longer. A refusal that names only Universal Credit is a different result from a refusal that names income, residence or work.
  4. Only then decide whether to close Universal Credit If the whole-claim comparison on the GOV.UK childcare calculator and MayTally’s TFC versus UC tool still favours Tax-Free Childcare, and Universal Credit was the only refusal reason, you can close the claim and apply again. If another rule failed, stay on Universal Credit.

What if the first decision is a refusal because Universal Credit is still live?

That is the result HMRC’s manual expects. A live Universal Credit claim is a legal bar on the date of the declaration. The useful part of the letter or on-screen result is the other reasons, if any. TFC12050 says: if the Universal Credit account is the only reason you are ineligible, and nothing else in your circumstances has just changed, you can then decide to cancel Universal Credit and reapply for Tax-Free Childcare.

Applying does not, on Turn2us’s reading, close Universal Credit by itself. You still have to end the claim. That is why GOV.UK can say both “wait for a decision before cancelling” and “you cannot open a Tax-Free Childcare account until you close Universal Credit” without those lines cancelling each other.

When should I cancel Universal Credit after the decision?

After a decision that Tax-Free Childcare would otherwise be open to you, cancel Universal Credit only if the whole award — not the childcare line — is worth less than the 20% top-up. Entitledto states that a Tax-Free Childcare award terminates housing, child and standard amounts as well as the childcare element. There is no official crossover income. If the comparison is close, stay on Universal Credit until you have run the figures again.
