Do formula baby club samples share data with advertisers?

Which ad partners do the UK privacy notices name?

This page reads the live privacy notices. It does not rank brands or advise on feeding. SMA Baby (Nestlé) says it does not license or sell personal data to third parties for those parties’ own marketing except where you have given consent, and that identities are disclosed when that consent is sought. The same notice then names partners it already works with for advertising measurement and “more relevant advertising”.

SMA’s notice also describes server-side tools such as Facebook Conversions API, which send events from Nestlé’s server to Meta without relying only on a browser cookie. Cow & Gate’s UK policy, last updated 10 May 2021 on the page we read, still lists those social and search ad platforms in its processor table.

Is joining a club the same as sharing with advertisers?

Two layers sit on one form. The club layer stores identity, contact details and a due date or birth date so content can be staged. SMA’s notice says it asks for expected or actual birth date and the baby’s gender to personalise information to the stage of pregnancy or the age of the baby, citing the legal rules on communicating about baby-food products, and that personalised offers need prior express consent.

The advertising layer is the pixel, tag, conversions API and hashed-audience upload. SMA states it is a joint data controller with Meta and some other partners for that processing. Cow & Gate lists Facebook behavioural data for retargeting and lookalikes, and Google advertising “to tailor advertising based on your behaviour on our website, or exclude you from advertising”. A sample tin in the post does not have to mention those partners. The privacy notice does.

Cow & Gate says it will get express opt-in consent before sharing personal data with any third party for Nutricia’s marketing purposes. That sentence is about partner marketing emails. It is not a claim that Facebook or Google tags are off until you tick a second box — those sit in the advertising table.

What does the Unicef Code say about clubs and samples?

Unicef UK’s health-workers’ guide says the International Code means companies may not give free samples to mothers, may not promote products in hospitals or to the general public, and may not have direct contact with mothers. The same guide warns that commercial bags and books often try to persuade mothers to visit websites or sign up to clubs, newsletters and social-media groups, and that contact details collected that way can be sold on.

UK law on infant-formula advertising is narrower than the Code. This page does not interpret feeding rules. It only records that a club welcome gift sits inside a marketing system the Code already treats as contact with parents.

How do I withdraw consent or stop the ads?

  1. Use the club’s own preference centre first SMA’s notice says you can unsubscribe in each message, adjust boxes in the account, or call consumer engagement. It also separates marketing opt-out from personalisation opt-out. Cow & Gate points members to account deletion or the Careline (8am–8pm, Monday to Friday on the page we read).
  2. Turn off the browser and platform ad settings SMA describes Google Ad Settings and the Google Analytics opt-out add-on. Social networks have their own ad-profile controls. Those switches affect the pixel layer, not the postal sample.
  3. Object to direct marketing if messages continue The ICO’s right to object says organisations cannot refuse a request that is about advertising or marketing aimed at you. They may keep a suppression list so the same address is not mailed again.
  4. Ask for erasure if you want the profile gone The ICO’s right to erasure applies when you withdraw consent or object to direct marketing, with listed exceptions. Cow & Gate says consent records for health and marketing are kept while consent is valid and for seven years after it ends.

In shortIn short: the sample is the visible half. SMA and Cow & Gate already name Meta, Google and other ad platforms in their UK notices. Withdraw the marketing tick in the club account, then use the ICO objection and erasure routes if the profile should stop travelling.

Questions parents ask

Does a sample tin mean my details have already gone to Meta or Google?
Not automatically. The notices describe site tags, conversions APIs and hashed audience uploads that run when you use the website or consent to marketing and personalised advertising. A posted tin is a fulfilment step. The advertising layer is the account, the pixels and the hashed identifiers.
SMA says it does not sell my data. Does that close the question?
The SMA notice carves out sales of data for other companies’ own marketing unless you consent. It still names Meta, Google, the Trade Desk and Amazon as partners for measuring ads and building lookalike or aggregated audiences, and it calls itself a joint controller with Meta for some of that processing.
Can I keep the club emails and still leave the ad partners?
Sometimes. SMA splits marketing communications from personalisation and from cookie settings. Cow & Gate lists advertising processors separately from Careline notes. Turning off one box may leave another on. Read both toggles, then the ICO objection route if a channel continues.
Is this page telling me which formula to buy?
No. It quotes privacy notices and the Unicef Code on commercial contact. Feeding questions belong with your midwife, health visitor or the NHS infant-feeding pages.
